End User License Agreement (EULA)

App: Unpaged
Developer: Andrei Baluta

Last updated: October 12, 2026

This End User License Agreement ("Agreement") is a legal agreement between you ("you") and Andrei Baluta ("Developer," "we," "us") for the use of the Unpaged application and any related services (the "Application"). By downloading, installing, or using the Application, you agree to be bound by this Agreement. If you do not agree, do not download, install, or use the Application.

This Agreement is concluded between you and the Developer only, and not with Apple Inc. ("Apple"). The Developer, not Apple, is solely responsible for the Application and its content.

1. Acknowledgement

You and the Developer acknowledge that this Agreement is concluded between you and the Developer only, and not with Apple. The Developer, not Apple, is solely responsible for the Application and the content thereof. This Agreement does not provide for usage rules for the Application that conflict with the Apple Media Services Terms and Conditions; the Developer's terms govern to the extent they are not less restrictive than those terms.

2. Scope of License

The Developer grants you a non-transferable license to use the Application on any Apple-branded products that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions. The license is limited to a non-exclusive license to use the Application on Apple devices you own or control and as permitted by the Usage Rules. You may not distribute or make the Application available over a network where it could be used by multiple devices at the same time, except as permitted by Apple. You may not transfer, redistribute, or sublicense the Application, and you may not copy, reverse- engineer, disassemble, attempt to derive the source code of, modify, or create derivative works of the Application except to the extent permitted by applicable law.

3. Subscriptions and In-App Purchases

The Application offers the following optional paid features, purchased and managed through your Apple ID:

  • Unpaged Plus — an auto-renewable subscription that includes on-device Apple Intelligence moment naming and recaps, plus optional private iCloud Sync for your library, progress, bookmarks, recaps, equalizer settings, and listening history. Plus is offered monthly (US$2.99/month) and yearly (US$14.99/year); prices vary by region and the price shown by Apple at purchase applies. Each plan may show a seven-day free trial when Apple offers it to your account. After any displayed trial, the subscription automatically renews at the selected plan's price unless auto-renew is turned off at least 24 hours before the trial or current period ends. Your account is charged for renewal within 24 hours before the current period ends. You can manage or cancel the subscription in your Apple ID account settings; cancellation takes effect at the end of the current period, and no refund is provided for the unused portion of a term except as required by law. iCloud Sync is opt-in and requires an iCloud account on the device. Audio files themselves are not synced and remain on each device.
  • Earlier paid purchases — an owned, non-consumable AI Features unlock continues to include Plus without an expiration. An active legacy iCloud Sync subscription continues to include Plus while that subscription is active. These existing entitlements do not require a new Plus purchase.
  • Buy me a coffee — an optional, one-time consumable purchase that lets you support the Developer. It does not unlock features, add content, provide priority, or provide any other benefit. It creates no entitlement and cannot be restored; you may purchase it again whenever you choose. The price shown at purchase is the price charged by Apple for your storefront.

All payments are processed by Apple. Restore purchases in Unpaged Plus settings on a new device using the same Apple ID. The consumable coffee tip is intentionally not restorable.

4. Maintenance and Support

The Developer is solely responsible for providing any maintenance and support services for the Application, as specified in this Agreement or as required by applicable law. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Application. For support, contact andrei.baluta@yahoo.com.

5. Warranty

The Developer is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the Application to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Application, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be the sole responsibility of the Developer.

6. Product Claims

The Developer, not Apple, is responsible for addressing any claims by you or any third party relating to the Application or your possession and/or use of the Application, including but not limited to: (i) product liability claims; (ii) any claim that the Application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation, including in connection with the Application's use of any features. This Agreement does not limit the Developer's liability beyond what is permitted by applicable law.

7. Intellectual Property Rights

You acknowledge that, in the event of any third-party claim that the Application or your possession and use of the Application infringes that third party's intellectual property rights, the Developer, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

9. Public-Domain Content

The Application provides access to free, public-domain audiobooks from LibriVox and the Internet Archive. That content is provided by those third parties under their own terms, and the Developer makes no warranty as to its accuracy, availability, or fitness for any purpose.

10. Privacy and Data

The Application does not collect, sell, or share your personal data with the Developer. AI generation runs on-device using Apple Intelligence. Primary AI transcription also runs on-device; the legacy Speech fallback requires on-device recognition support and does not permit server processing. Network requests support free-book browsing, streaming, and downloads through LibriVox/Internet Archive, purchases through Apple (including the optional coffee tip), your connected Audiobookshelf server for browsing, streaming, downloads and listening progress, and optional Plus iCloud Sync in your private iCloud account. Downloaded server audio can use the same on-device AI as imported audio. The Developer operates no backend server. Full details are in the Privacy Policy: https://andreibalu.github.io/Ebooker/privacy/

11. Developer Name and Address

Any questions, complaints, or claims with respect to the Application should be directed to:

Andrei Baluta
Surorile Martir Caceu 7, Timisoara, Timis, Romania
Email: andrei.baluta@yahoo.com

12. Third Party Terms of Agreement

You must comply with applicable third-party terms of agreement when using the Application (for example, your wireless data service agreement).

13. Third Party Beneficiary

You and the Developer acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of this Agreement, and that, upon your acceptance of the terms and conditions of this Agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce this Agreement against you as a third-party beneficiary thereof.

14. Limitation of Liability

To the maximum extent permitted by applicable law, in no event will the Developer be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Application.

15. Termination

This Agreement is effective until terminated. Your rights under this Agreement will terminate automatically without notice if you fail to comply with any of its terms. Upon termination, you must cease all use of the Application.

16. Governing Law

This Agreement is governed by the laws of Romania, without regard to its conflict-of-law principles, except where prohibited by applicable law.

17. Unpaged for Android

If you obtained the Application from Google Play for an Android device, this section applies and replaces the Apple-specific terms. The Agreement is between you and the Developer only; Google is not a party to it and is not responsible for the Application. Sections 1, 3 and 13, and the references to Apple devices, Apple usage rules and the Apple Media Services Terms and Conditions in Section 2, do not apply. The Developer grants you a non-exclusive, non-transferable license to use the Application on Android devices you own or control, subject to the Google Play Terms of Service. All other restrictions in Section 2 still apply.

The Android version has no purchases, subscriptions or iCloud Sync. Its optional on-device AI features use Gemini Nano through Google's ML Kit and an open-source speech model downloaded from Hugging Face with your consent, as described in the Privacy Policy. Android backups of your library are handled by Android and your backup provider, under their terms.
